Passport and Visa rules
As a traveler, it is your responsibility to ensure that your passport is valid and complies with the requirements for international travel. The Tripwise, along with its affiliates and partners, disclaims any liability for issues arising due to an ineligible passport at the time of travel. To ensure smooth travel, please adhere to the following passport and visa guidelines:
- Passports must have a minimum validity of 6 months (12 months for a social visa) from the date of your return, and possess adequate pages for visa stamps or stickers.
- Handwritten passports are not acceptable.
- Ensure that your passport includes a barcode and is free from mutilation or tampering.
- Additionally, the name on your passport should match the name on your flight ticket and other travel documents. In the event of any discrepancies in names or letters, please contact representatives of the service providers promptly to avoid issues such as denied boarding, for which The Tripwise will not be responsible or provide refunds.
The Tripwise serves as a facilitator for clients in submitting visa applications and related services to relevant institutions and immigration authorities. While we strive to process visa applications within the committed timelines as outlined in our materials, we cannot guarantee specific timeframes for visa processing. The Tripwise is not accountable for any changes in rules, regulations, or processing requirements by immigration authorities or other entities that may affect the visa processing timeline.
We are not responsible for any costs incurred due to delays in the visa process arising from factors beyond our control. In the case of short-stay business and tourist visas, although The Tripwise may request Double or Multiple entry visas, the final decision, including the issuance of a Single entry visa, rests with the embassy, over which we have no influence.
Clients are advised against booking flight tickets for any visa, especially tourist or business visas, unless specifically required by the embassy as part of the visa application. No refunds will be provided in case of visa denial. The Tripwise has no control over decisions made by immigration authorities, including requests for additional information, delays in visa issuance, or visa denials.
Force Majeure
The Tripwise, including its parent companies, affiliates, officers, directors, employees, agents, or suppliers, shall not be held liable for any failure or delay in fulfilling its obligations where such failure or delay is due to unforeseen circumstances beyond its reasonable control, known as a “Force Majeure” event. This includes, but is not limited to, acts of war (declared or undeclared), sabotage, embargoes, terrorism, riots, transportation failures, government actions, natural disasters (such as fires, explosions, floods, earthquakes), epidemics, or quarantine restrictions. In the event of a Force Majeure, both you and The Tripwise are expected to make reasonable efforts to mitigate the impact and resume normal operations once conditions permit. It is important to note that obligations accrued before a Force Majeure event are not waived or nullified by such circumstances.
Transaction Privity
The Tripwise serves as an intermediary in assembling travel packages, combining services from various third-party vendors and service providers for your convenience. Our platform facilitates the organization of your travel plans by integrating different services into a single package. Please note:
- The contractual terms regarding price, payment methods, delivery dates, warranties, and after-sales services are set by and agreed upon solely between The Tripwise and the service providers. These terms are consolidated into the travel packages we offer to our customers.
- As our esteemed customer, your direct interaction with the service providers is typically not required until the actual time and place of service delivery, as prearranged by The Tripwise.
- While bookings are made on behalf of the customer by The Tripwise, we do not exert control or authority over the service providers. Our role is to facilitate the provision of these services within our capacity, ensuring the agreed-upon services are delivered by the providers.
- In the event a service provider fails to fulfill their obligations, The Tripwise is committed to making reasonable efforts to offer alternative solutions to ensure a satisfactory customer experience. However, such circumstances shall not legally bind The Tripwise or be construed as a failure on our part.
- The Tripwise, including its affiliates and representatives, will not be liable for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever arising from the use of our Website or from the failure of service provision by third parties.
- We do not provide warranties regarding the specifics (such as legal title, creditworthiness, identity, etc.) of any service providers. It is our recommendation, but not obligation, for customers to perform due diligence on service providers featured in our travel packages.
- The Tripwise is not liable for any delays, performance issues, or non-performance of obligations due to causes beyond our reasonable control, including Force Majeure events or issues at the end of airlines, rails, buses, hotels, or transporters.
Privacy
Privacy and the protection of your personal data are of paramount importance to The Tripwise. By agreeing to these Terms of Use, you acknowledge that you have thoroughly reviewed, understood, and unconditionally accepted our Privacy Policy. Our Privacy Policy outlines how we collect, use, store, and protect your personal information. It also details your rights regarding your data and how you can exercise them. Payment and Refund
- The full payment for the travel package must be completed at least 10 days prior to the travel date. Failure to do so may result in cancellation of the booking without refund.
- In the event of discontinuation of travel for personal reasons, refunds will not be issued.
- Cancellation: No refunds will be provided for cancellations made within 10 days of the travel date or for cancellations due to weather conditions or personal choices.
- Transportation: If a booked cab, whether it is private or shared basis, departs after a 30-minute wait, the activity will be considered cancelled without refund. Rebooking may incur additional charges.
- Accommodation: Hotel selections, once confirmed by the customer, are final. Changes to hotel bookings may result in additional costs.
- Additional Activities: Any additional activities or services requested during the tour must be paid for in advance. The Tripwise will not cover these additional costs.
- Outstanding Payments: Any dues remaining post-travel must be settled within two weeks. Failure to do so may lead to legal proceedings.
- Taxes: All tourism-related taxes or other applicable taxes will be borne by the customer.
- The Tripwise is not liable for the loss or theft of personal belongings such as money, bags, wallets, passport etc. We advise customers to take care of their belongings. Should you require assistance in retrieving lost items, additional charges may apply.
COVID-19 Bookings, Cancellation and Refund
In light of the COVID-19 pandemic, The Tripwise acknowledges that travel plans may be impacted. Customers understand that in certain circumstances, service providers or The Tripwise may need to cancel bookings or deny services. Such circumstances may include, but are not limited to, the Customer exhibiting symptoms of COVID-19, non-compliance with health and safety guidelines, or other directives from governmental or health authorities.
- In instances where service is denied or bookings are canceled due to COVID-19 related reasons, The Tripwise is not liable for the refusal of service by the service providers.
- Refunds for cancellations due to COVID-19 will be processed by The Tripwise, subject to the reimbursement received from the respective service providers.
- Customers are required to adhere to all COVID-19 related travel guidelines and SOPs as mandated by central and state governments or other relevant authorities. Non-compliance may result in the denial of travel services, and in such cases, The Tripwise will not be liable. Any potential refunds will be subject to the terms set by the end service providers.
This policy is subject to change in response to ongoing developments in travel guidelines and health advisories related to COVID-19.
Mode of Refund
- Refunds for cancellations or service modifications can be issued either as a credit note/voucher, returned to the original payment method or in cash, based on the discretion of The Tripwise. Credit notes/vouchers may be applied towards future travel, adhering to the applicable terms and conditions.
- In scenarios where the service provider does not offer a refund based on their policy, The Tripwise will not provide a refund to the customer. The ability to issue a refund is contingent upon the refund criteria and the receipt of funds from the respective service provider.
- The decision regarding the mode of refund, be it a credit note/voucher, returned to the original payment method or cash, will be determined by The Tripwise depending on the specific circumstances surrounding the cancellation or service change.
Indemnification and Refund Limitations
- As a customer of The Tripwise, you agree to indemnify and hold The Tripwise, its affiliates, officers, directors, and legal successors harmless against any losses, liabilities, claims, damages, costs, and expenses (including reasonable legal fees) that may arise due to any breach of representations, warranties, or agreements made by you, or due to your failure to adhere to the covenants outlined in these Terms and Conditions.
- The Tripwise reserves the right to withhold or forfeit refunds if it is determined that you have violated any terms and conditions of this agreement. This policy is in place to ensure adherence to the agreed terms and to protect the integrity of our services.
Customer Responsibilities and Conduct
- As a valued customer, your feedback and contributions are important to us. However, you are solely responsible for the content of your submissions related to The Tripwise, including but not limited to reviews and comments posted on our website, social media platforms, or any other communication channels.
